🏛️ Preamble
We, the people of Ruin Roleplay II, in order to establish justice, ensure domestic tranquility, provide for the common defense, and secure the blessings of liberty, do ordain and establish this Constitution. We recognize the State as a sovereign entity, governed by the Rule of Law within the City and the imperative of Security within the Northern Territories.
🗺️ Article I: Territory & Jurisdictional Zones
The State recognizes two distinct legal zones with differing operational protocols.
Section 1: The Urban Zone (Los Santos)
- Definition: The metropolitan area south of the Border Checkpoints.
- Governing Law: Civil Law.
- Primary Authority: The Mayor and the Los Santos Police Department (LSPD).
- Status: A protected zone where the constitutional rights of citizens are absolute and prioritized.
Section 2: The Northern Territory (The Badlands)
- Definition: The territory north of the Border Checkpoints (Sandy Shores, Grapeseed, Paleto Bay).
- Governing Law: Restricted Civil Law & Military Protocol.
- Primary Authority: The Military Police (MP).
- Status: A High-Security Zone due to insurgent threat levels. While citizens reside here, the State reserves the right to enforce stricter security measures, including checkpoints and controlled carry laws.
⚖️ Article II: The Bill of Rights
The fundamental freedoms of every citizen.
Section 1: Freedom of Expression
- The State shall make no law abridging the freedom of speech or of the press.
- Weazel News and independent journalists have the right to document government actions, provided they do not obstruct active emergency operations or compromise National Security.
Section 2: The Right to Bear Arms
- Possession: Citizens have the right to keep and bear arms for self-defense, subject to regulation.
- Regulation:
- The possession of Class-1 Firearms (Pistols) is permitted with a valid license.
- The possession of Class-2 Firearms (Automatic Rifles) is restricted to State Forces and authorized personnel only.
- Open Carry: Open carry of firearms is prohibited within the Urban Zone to prevent public panic.
Section 3: Right to Due Process
- No person shall be deprived of life, liberty, or property without due process of law.
- Legal Counsel: Every person arrested has the right to an attorney. If they cannot afford one, a Public Defender will be appointed.
- Fair Trial: Every citizen is entitled to a fair and speedy trial before a Judge of the Department of Justice.
Section 4: Protection from Unreasonable Search
- Urban Zone: Law Enforcement may not search a person, vehicle, or private dwelling without Probable Cause or a Judicial Warrant.
- Northern Territory: Due to security risks, Military Police are authorized to conduct searches at Border Checkpoints without warrants to prevent contraband trafficking.
👔 Article III: The Executive Branch
The Powers of the Government.
Section 1: The Office of the Governor/Mayor
- The Governor/Mayor is elected by the people.
- Powers:
- Administration of the State Budget and Taxes.
- Oversight of Public Services (EMS, Public Works).
- Appointment of Department Heads.
- Checks and Balances: The Mayor cannot dictate judicial verdicts nor command the Military to act against innocent civilians.
Section 2: Emergency Powers
- In times of crisis (Invasion, Pandemic, Mass Terrorism), the Executive may declare a State of Emergency.
- During this state, the LSPD and MP operate as a Joint Task Force, and certain civil liberties (such as Curfew) may be temporarily enforced.
👮 Article IV: Law Enforcement Agencies
The Sword and The Shield of the State.
Section 1: Los Santos Police Department (LSPD)
- Mandate: To Protect and To Serve the civilian population of the Urban Zone.
- Authority: The LSPD is the primary agency for criminal investigation, traffic enforcement, and maintaining public order in the city.
Section 2: Military Police Force (MP)
- Mandate: To Defend the State from domestic and foreign threats in the Northern Territory.
- Authority: The MP ensures the security of supply lines and borders. They possess the authority to engage heavy threats (Insurgencies) that exceed LSPD capabilities.
Section 3: Joint Operations
- While jurisdictions are separate, the State authorizes Joint Task Forces. The LSPD and MP may cross jurisdictional lines when in pursuit of a fugitive or during coordinated raids on high-value targets.
👨⚖️ Article V: The Judicial Branch
The Interpreter of the Law.
Section 1: The Supreme Court
- The Judicial power is vested in the Department of Justice (DOJ).
- The High Court has the power to interpret this Constitution and strike down any Executive Action or Law deemed unconstitutional.
Section 2: The Universal Summons
- Supreme Authority: No individual is above the law.
- The Summons: If a Judge issues a court summons, the individual whether a private citizen, a Police Chief, or a Criminal Warlord MUST appear.
- Contempt: Failure to appear results in a Federal Warrant for arrest, authorizing all State Forces to capture the fugitive.
📘 Article VI: The Penal Code
The definition of Crimes and Punishments.
This Constitution ratifies the Ruin Roleplay II Penal Code as the official guide for sentencing. All crimes are categorized as follows:
Section 1: Infractions (Class C)
- Definition: Minor offenses involving no violence or theft.
- Examples: Speeding, Jaywalking, Illegal Parking, Public Intoxication.
- Punishment: Monetary Fines only. No jail time.
Section 2: Misdemeanors (Class B)
- Definition: Crimes involving minor theft, non-lethal violence, or public disturbance.
- Examples: Petty Theft, Verbal Harassment, Joyriding, Simple Assault (Fist fight).
- Punishment: Fines and/or Short-Term Imprisonment.
Section 3: Felonies (Class A)
- Definition: Serious crimes involving weapons, high-value theft, or intent to harm.
- Examples: Armed Robbery (Store/Bank), Grand Theft Auto, Drug Trafficking, Possession of Class-2 Weaponry, Assault with a Deadly Weapon.
- Punishment: Heavy Fines and Long-Term Imprisonment.
Section 4: Capital Crimes (Federal Offenses)
- Definition: Crimes against the State or Life.
- Examples: First Degree Murder, Terrorism, Treason, Kidnapping of a Government Official, Attempted Murder of LEO.
- Punishment: Maximum Sentence (Life Imprisonment) or the Death Penalty (CK).
🏛️ Article VII: Political Integrity
Corruption and Governance.
Section 1: Financial Transparency
- The State Treasury is public property. Embezzlement of funds by Government officials is a High Crime.
- Any Politician found guilty of financing Terrorism (Gangs) shall be immediately removed from office and prosecuted.
Section 2: The Integrity of Elections
- Elections must be free and fair.
- Any act of voter intimidation, ballot fraud, or bribery is a Felony, punishable by immediate disqualification and imprisonment.
